TWO PEOPLE BROUGHT TO MANYARA RESIDENTS MAGISTRATE COURT FOR ACCUSATION OF KILLING GIRAFFE

The suspected illegal hunters after being arrested by the patrol officers

Two People, both residents of Minjingu village in Babati district of Manyara Region, have been brought to the   resident magistrate court in Manyara region on suspicion of  founding with the whole carcas of freshly killed Giraffe.


The accused are Masiali Lais Kipar (19) and Paulo Richard (23) who were also arrested with three knives and one spear.

The Police Prosecutor, Assistant Inspector of Police, Obedi Machumu before the resident Magistrate  court of the Manyara regional, John Masao said, the accused were arrested on February 14, 2023 at 17:00hrs in the area of ​​the Burunge wildlife Management Area.


He said the defendants were arrested by the wildlife soldiers, in collaboration with the Burunge Wildlife Management Area soldiers in collaboration with the chem chem Association Soldiers.

He said the defendants were found with the small giraffe weighing 54.5 kilograms that they had already killed worthy 35.1 million Tanzanian shillings, the government property against the law of ownership of national spoils and economic sabotage.

 

Machumu said that in another case, the defendants were found with three knives and a spear in a confusing environment in which they were accused of committing a crime.

However, the accused, after being interrogated by the Magistrate, Masao in relation to the charges, the first accused, Kipar, confessed and the second accused denied the crime.

However, the Resident Magistrate Masao, asked the Prosecutor, Machumu to read the preliminary information to the accused.


He said on February 14, 2011 wildlife officers Samuel Daudi Bayo, James Lesuka and Michael Mbilinyi while on regular patrol in the Burunge WMA Area, arrested the accused, with the meat of the giraffe, the younger one having already cut off one of its legs.


Kipar denied the information and explained to the court that on the day of the incident he was swimming in the river and he did not kill the Giraffe but two people who killed the giraffe ran away where he also denied owning a knife and a spear.


The second accused also denied the explanation on the day of the incident and explained that he was arrested on his way home from herding cows.


The accused also denied owning the knife and spear that were seized in the operation.


After their explanation, the prosecution explained that has six witnesses and five exhibits and asked the court to accept the first witness, Sergeant James (45) to give out the
evidence.

Giving his evidence, Sergeant James said that on February 14, at 7:30 p.m. as an exhibit keeper at the Babati Police station, he was handed Giraffe meat, a spear and three Knives as exhibits.


He said the equipment was handed to him by Wildlife officer Samuel Bayo for evidence in the case.


Prosecutor Machumu, asked the court to accept the equipment as evidence and later asked the court to see the Giraffe parties that were arrested so that it would later be burned due to deterioration.
 

Magistrate  Masao agreed to the request and went out of court to witness the evidence and later ordered the meat to be burned in the wild.

The defendants, however, had no objection regarding the receipt of the specimens and the burning of the meat.


 Magistrate Masao said the bond for the suspects is clear but they must have guarantors with immovable property worth more than 10 million and individual guarantors who will also sign the bond.


The case has been adjourned until February 28 and the suspects were returned to prison to complete bail procedures.
